Modern Kazakhstan is a country rich in minerals. Copper, iron, aluminum and uranium ore production has been central to its economy since the Soviet time. The state also mines for rare and expensive metals like molybdenum, tungsten, zinc, gold – and many more. Over the past decades, the Kazakh national elite, especially the younger generation, has warmly embraced a pro-western lifestyle, settled in European capitals and opened international companies to manage domestic resources, attracting powerful foreign partners. Naturally, the Kazakh legislation and politics had to follow. The country is making a big turn to become a pro-arbitral jurisdiction with a relatively low threshold for recognition and enforcement of arbitral awards. Since 2013 the country is one of the fulcrum points of the Chinese Belt and Road Initiative. Since 2016 a new Law on Arbitration based on the UNCITRAL Model Law is in force in Kazakhstan. In the spring of 2019 Kassym-Jomart Tokayev became a successor to the President Nursultan Nazarbayev after his 29-year reign. Our generation will witness what use Kazakhstan will make of its plentiful resources – and what partners it will choose on this path.
